Terms of Service

These Terms of Service (“Terms”) govern your use of LiveCustomer (“LiveCustomer,” “we,” “us”), a product of CGMIMM. By creating an account or using the service, you agree to these Terms.

1. The service

LiveCustomer provides an AI-powered chat assistant that you can configure and embed on your website(s) to answer questions and capture leads. Features available depend on your subscription plan.

2. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. You must provide accurate information and promptly update it as needed. You must be at least 18 years old to create an account.

3. Free trial, subscriptions & billing

• New subscriptions begin with a 14-day free trial. A valid payment method is required to start the trial; you are not charged during the trial.
• Unless you cancel before the trial ends, your subscription automatically converts to a paid plan and your card is charged the then-current monthly rate.
• Subscriptions renew automatically each billing period until cancelled. Payments are processed by Stripe.
• You may cancel or change your plan at any time from the billing portal in your dashboard. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable except where required by law.
• We may change pricing with reasonable advance notice; changes apply to subsequent billing periods.

4. Acceptable use

You agree not to use LiveCustomer to: violate any law; send spam or harass others; deploy bots on sites you do not control or are not authorized to manage; attempt to disrupt, reverse engineer, or gain unauthorized access to the service; or collect data in violation of applicable privacy laws. You are responsible for the content of your bot and for providing any legally required notices to your visitors.

5. Your data

You retain ownership of your account data, bot configuration, and the leads and conversations captured through your bots. You grant us a limited license to process this data to provide the service. Our handling of personal information is described in our Privacy Policy.

6. AI-generated content

Bot responses are generated by artificial intelligence and may be inaccurate or incomplete. They are not professional, legal, medical, or financial advice. You are responsible for reviewing your bot’s configuration and for any reliance placed on its responses.

7. Third-party services

The service integrates with third parties (including our AI provider, Stripe, Twilio, ClickSend, Resend, Meta, and Cloudflare). Your use of those integrations may be subject to their respective terms.

8. Termination

You may stop using the service and cancel at any time. We may suspend or terminate accounts that violate these Terms or that pose a security or legal risk. Upon termination, your right to use the service ends; we may delete your data in accordance with our retention practices.

9. Disclaimers & limitation of liability

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, LiveCustomer and CGMIMM are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold LiveCustomer and CGMIMM harmless from claims arising out of your use of the service, your content, or your violation of these Terms or applicable law.

11. Governing law

These Terms are governed by the laws of the United States and the state in which CGMIMM is established, without regard to conflict-of-laws principles.

12. Changes

We may update these Terms; material changes are reflected by the “Last updated” date. Continued use after changes constitutes acceptance.
